الملكية الفكرية:
تحتفظ واحة المحاصيل بكامل حقوق الملكية الفكرية على المنصة ومحتواها وهويتها البصرية، وباستخدامك للتطبيق فأنت تقر بموافقتك التامة على البنود التالية:
أولاً: ملكية العلامة التجارية والمحتوى
1. الملكية: جميع العلامات التجارية والأسماء والشعارات والرموز والتصاميم الظاهرة في التطبيق هي ملك خالص لواحة المحاصيل (مجموعة تركي عمر)، ولا يجوز استخدامها أو نسخها أو تعديلها دون إذن كتابي مسبق.
2. المحتوى المحمي: تشمل الحماية النصوص والصور والرسوم والواجهات وقواعد البيانات والشيفرة البرمجية للتطبيق، وتُعد جميعها أعمالاً محمية بموجب أنظمة حقوق المؤلف المعمول بها.
ثانياً: نطاق الترخيص الممنوح للمستخدم
1. ترخيص محدود: يُمنح المستخدم ترخيصاً شخصياً غير حصري وغير قابل للتحويل لاستخدام التطبيق لأغراض الطلب والبيع والنقل فقط.
2. القيود: لا يمنح هذا الترخيص أي حق في إعادة نشر المحتوى أو بيعه أو تأجيره أو إدراجه في خدمة أخرى، ولا في عكس هندسة التطبيق أو استخراج بياناته آلياً.
ثالثاً: المحتوى المقدم من المستخدمين
1. مسؤولية المستخدم: يقر المستخدم بأنه يملك الحقوق الكاملة على ما ينشره من صور وأوصاف للمنتجات، وأنها لا تنتهك حقوق أي طرف آخر.
2. ترخيص الاستخدام: يمنح المستخدم واحة المحاصيل ترخيصاً غير حصري لعرض هذا المحتوى داخل المنصة وفي موادها التعريفية بما يخدم إتمام العمليات.
3. التعويض: يتحمل المستخدم كامل المسؤولية القانونية والمادية عن أي مطالبة تنشأ عن محتوى نشره، ويلتزم بتعويض المنصة عن أي ضرر يترتب على ذلك.
رابعاً: الاستخدامات المحظورة
1. يُحظر انتزاع البيانات آلياً أو استخدام أي وسيلة تقنية لجمع محتوى المنصة أو بيانات مستخدميها.
2. يُحظر استخدام العلامة التجارية أو الشعار في أي مادة تسويقية أو إعلانية أو نطاق إلكتروني دون تصريح رسمي.
3. يُحظر تقليد واجهات التطبيق أو تصميمه أو إنشاء خدمة مشتقة منه.
خامساً: الإبلاغ عن التعدي وآلية المعالجة
1. الإبلاغ: يحق لأي طرف يرى أن حقوقه قد انتُهكت داخل المنصة أن يتقدم بإبلاغ مرفقاً بما يثبت ملكيته للحق.
2. المعالجة: تلتزم إدارة التطبيق بدراسة الإبلاغ وإزالة المحتوى المخالف أو تعطيله عند ثبوت التعدي.
3. الجزاءات: يحق للإدارة فرض غرامات مالية أو حظر الحسابات (مؤقتاً أو دائماً) في حال تكرار التعدي على حقوق الملكية الفكرية.
سادساً: الاختصاص القضائي
تخضع هذه السياسة لأنظمة المملكة العربية السعودية، وتختص الجهات القضائية المختصة فيها بالفصل في أي نزاع ينشأ عن حقوق الملكية الفكرية.
Intellectual Property
Wahat Almahsil retains all intellectual property rights in the platform, its content, and its visual identity. By using the application, you acknowledge your full acceptance of the following terms:
First: Ownership of the Trade Mark and Content
1. Ownership: All trade marks, names, logos, symbols, and designs appearing in the application are the exclusive property of Wahat Almahsil (Turki Omar Group), and may not be used, copied, or modified without prior written permission.
2. Protected content: Protection extends to the text, images, artwork, interfaces, databases, and source code of the application, all of which are works protected under the applicable copyright regulations.
Second: Scope of the Licence Granted to the User
1. Limited licence: The user is granted a personal, non-exclusive, non-transferable licence to use the application for the purposes of ordering, selling, and transport only.
2. Restrictions: This licence confers no right to republish, sell, rent, or incorporate the content into another service, nor to reverse-engineer the application or extract its data by automated means.
Third: User-Submitted Content
1. User responsibility: The user warrants that they hold full rights to the product images and descriptions they publish, and that these do not infringe the rights of any third party.
2. Licence to use: The user grants Wahat Almahsil a non-exclusive licence to display that content within the platform and in its promotional materials, to the extent that this serves the completion of transactions.
3. Indemnity: The user bears full legal and financial responsibility for any claim arising from content they have published, and undertakes to indemnify the platform for any resulting damage.
Fourth: Prohibited Uses
1. Automated data extraction, or the use of any technical means to harvest platform content or user data, is prohibited.
2. Use of the trade mark or logo in any marketing or advertising material, or in a domain name, without official authorisation is prohibited.
3. Imitating the application's interfaces or design, or creating a derivative service from it, is prohibited.
Fifth: Reporting Infringement and Handling Procedure
1. Reporting: Any party who believes their rights have been infringed within the platform may submit a report accompanied by evidence of their ownership of the right.
2. Handling: The management of the application undertakes to review the report and to remove or disable the infringing content once infringement is established.
3. Sanctions: The management is entitled to impose financial penalties or to ban accounts (temporarily or permanently) in the event of repeated infringement of intellectual property rights.
Sixth: Governing Law and Jurisdiction
This policy is governed by the regulations of the Kingdom of Saudi Arabia, and the competent judicial authorities therein have jurisdiction to settle any dispute arising in relation to intellectual property rights.
